Welcome to NoBagrets

These Terms of Service govern access to the NoBagrets website, marketplace and related services. By creating an account and affirmatively accepting these Terms, you agree to follow them. The Privacy Policy explains how information is handled. This public website accepts membership requests and optional email subscriptions. Marketplace registration and member login are currently restricted.

1. Eligibility and membership

You must be at least 18 years old, provide accurate registration information and keep your account information current. You are responsible for safeguarding your credentials and activity you authorize through your account. Contact the operator promptly if you suspect unauthorized access.

Registration, email verification and marketplace approval are separate steps. Creating an account does not guarantee acceptance or access to listings. NoBagrets may approve, deny, suspend or terminate membership for legitimate safety, policy or operational reasons, subject to applicable law. Do not impersonate others, share access to evade restrictions or misrepresent your eligibility.

2. How the marketplace works

NoBagrets provides tools for approved members to list, discover, buy, sell and trade eligible pre-owned bags, straps, charms, wallets, pouches, accessories and related carry gear. NoBagrets is not a party to member transactions and does not take ownership or possession of listed merchandise. Members independently negotiate and complete their arrangements.

Private Alpha does not charge listing fees. Platform-service fees or credits may be introduced later with applicable pricing and terms disclosed before purchase. Such credits would not be payment for merchandise or transferable member funds. No buyer/seller payment processing is currently provided.

3. Payments and transaction responsibilities

NoBagrets does not collect or process marketplace purchase payments, hold buyer funds, settle member payments or provide escrow. Buyers and sellers choose their payment methods and agree directly on price, trade terms, shipping, insurance, taxes, pickup, delivery, returns, refunds and other obligations.

Members are responsible for performing their agreements and complying with applicable laws. Choose payment methods thoughtfully, inspect available information and understand any protections offered by your payment provider. NoBagrets does not guarantee completion, reimbursement, payment protection or recovery of funds. To the extent permitted by applicable law, NoBagrets is not responsible for payment disputes, shipment failures, fraud or misrepresentation by members.

4. Listings and seller responsibilities

List only goods permitted by the current marketplace rules, using approved active brands where required. Listings must accurately describe the item, condition, contents, damage, defects, modifications and relevant exposure or storage information. Photographs must be truthful and you must have the legal right to sell or trade the item and upload its content. Do not post counterfeit, stolen, prohibited or unlawful merchandise.

Unless a listing is explicitly sold together as a bundle, list one item per listing. Homemade, DIY, dropshipped, unbranded, replica, maker-produced, custom-order and commercial inventory listings are not permitted. Sale, trade and bundle listings require possession proof; ISO reference listings do not. Honor transaction terms you agree with another member. NoBagrets may review, decline, restrict or remove noncompliant listings.

5. Brand eligibility and possession evidence

Brand approval, membership approval and possession verification do not constitute authentication, certification or a guarantee of authenticity, ownership, condition or legitimacy. Approval is a platform eligibility decision, not endorsement of a brand, seller or item.

NoBagrets may request photographs or other evidence of possession, but cannot guarantee that an item is genuine, accurately described, lawfully owned or available. Buyers must conduct appropriate due diligence, ask questions and obtain independent advice or authentication where appropriate before completing a transaction.

6. Member communications

Listing questions and answers are visible to approved members who can view the listing. Private messages support direct transaction logistics between conversation participants. Do not use either feature for harassment, threats, fraud, spam or unlawful conduct. Use caution when sharing contact details, addresses or financial information; do not send passwords or payment-card credentials.

Private messaging is not represented as end-to-end encrypted. Authorized administrators may review reported messages and related context for safety, enforcement or legal compliance. This does not promise continuous monitoring or give administrators routine unrestricted access to all conversations. Information may be preserved or disclosed as described in the Privacy Policy and when legally required.

7. Prohibited conduct

Do not commit fraud; misrepresent items or identity; sell counterfeit or stolen goods; misuse accounts; harass, threaten or discriminate unlawfully; send spam; or evade access or moderation restrictions. Do not scrape private marketplace data without authorization, bypass security controls, introduce malware, probe accounts you do not control, interfere with the service or engage in other unlawful activity.

8. Your content and intellectual property

You retain ownership of your original photographs, descriptions and other content, and of your merchandise. You grant NoBagrets a limited, nonexclusive, royalty-free license to host, store, reproduce, display and technically process submitted content as necessary to operate the marketplace, including moderation, image processing and authorized backups. Private content remains subject to the visibility described in the Privacy Policy; this license does not authorize public promotion of private messages or private member content without appropriate permission.

Upload only content you have the rights to use. NoBagrets retains its rights in its own branding, software and original website materials; third-party marks remain their owners’ property. For an intellectual-property concern, contact the operator through the contact information below, identifying the work, affected content or listing, your relationship to the rights holder and a way to reply. The operator may request information needed to assess the claim and take appropriate action.

9. Moderation and account termination

NoBagrets may review submissions and reported activity, retain relevant evidence, remove listings, limit features, suspend accounts or terminate membership for violations or legitimate safety and operational concerns. Decisions may consider the severity, available evidence and prior activity. We do not promise to detect every violation or monitor activity continuously.

You may stop using the service and request account closure. Termination does not cancel your outstanding obligations to other members. Records may remain where reasonably necessary for security, disputes, auditability or legal obligations, as explained in the Privacy Policy.

10. Disputes between members

Members are primarily responsible for resolving their transaction disputes, including contacting relevant payment, shipping or legal channels. You may report suspected abuse or policy violations. NoBagrets may investigate and moderate platform activity, but is not obligated to mediate, adjudicate or resolve private transactions. Reports do not create escrow, reimbursement rights, buyer protection or a dispute arbitration service.

11. Service disclaimers and liability

The service is provided on an as-available basis. Development changes, maintenance, failures and third-party outages may interrupt access. We do not guarantee uninterrupted operation, error-free software, accuracy of member content or member conduct. Keep your own records of important agreements.

To the extent permitted by applicable law, NoBagrets disclaims warranties regarding service availability and user-submitted goods or content and is not liable for indirect, incidental, consequential or special losses resulting from use of the marketplace or member transactions. These provisions do not exclude or limit liability or consumer rights that applicable law does not permit to be excluded or limited, including responsibility for conduct where such a limitation is unlawful. No arbitrary monetary cap or mandatory arbitration term is established by this development version.

12. Changes to these Terms

We may update these Terms as the service or applicable requirements change. Updated text will display its revision date. Material changes will receive reasonable notice when required, and further affirmative acceptance will be requested where required. A later version does not rewrite the acceptance record for an earlier version.

13. Governing law, operator and contact

Operator: NoBagrets. These Terms are governed by Florida law, and any permitted dispute venue is Indian River County, Florida, subject to applicable law. Nothing in these Terms waives mandatory rights under applicable law.
